Globalisation and Court Practice in Iceland : New Case Law of the Supreme Court in Relation to the EEA Agreement and European Convention on Human Rights

This article examines the status of international treaties in Iceland law and how Icelandic court practice has developed in recent years in that area. With regard to the relationship between domestic law and international law, Iceland adheres to the principle of dualism. This means that international law does not come into force as Icelandic law unless implemented by the legislator. As a result, Icelandic Courts will not, in general, apply provisions of international treaties unless they have been incorporated into Icelandic statutory law. However, this does not mean that international obligation are not fulfilled, as Icelandic Courts will seek to interpret domestic law in line with international obligation to the extent possible. If an international treaty has been implemented into Icelandic law, its provisions are binding like other domestic law. With regard to the EEA Agreement, Icelandic Courts will seek to interpret national law in accordance with EEA obligations and follow the judgments of the EFTA Court if the Icelandic provision in question is open to such an interpretation. With regard to the European Convention on Human Rights, Icelandic Courts will even go a step further, as recent judgments show that Icelandic Courts tend to interpret the human rights provisions of the Icelandic Constitution in line with interpretation laid down by The European Court of Human Rights, even in cases where such an interpretation does not exactly fit within the direct wording of the provision in question. This is due to a special connection between the human rights chapter of the Icelandic Constitution and the Convention, as one of the legislators’ main goals when amending the Constitution in 1994 was to bring the human rights chapter more in line with the Convention.

Which types of resources are necessary to achieve competitive advantage?

In this article we test simultaneously various hypotheses of the RBV by taking into ac-count trade-offs and reinforcing effects between resources. Data consisting of 129 teams in the European professional soccer leagues between 1998 and 2003 was used to predict which types of resources are most significantly associated with firm perform-ance. The most important finding from this study is that socially complex intangible capabilities such as group routines have a positive impact on performance. According to our results, complementary factor markets for valuable resources do exist and their acquisition cannot be reduced to information asymmetry. We propose that causal am-biguity is about making difficult decisions with inherent trade-offs rather than about lack of understanding.

Who is ERIC? The politics and jurisprudence of a governance tool for collaborative European research infrastructures

Pan-European research infrastructures (RIs) have been labelled a 'pillar' of the European Research Area initiative (ERA) and 'engines' which are expected to drive forward the European Union (EU) economy by advancing its science and technology and ultimately its competitiveness on the global arena. The focus of this article is on the origins and nature of a policy tool named the European Research Infrastructure Consortium (ERIC), introduced by the EU in 2008 specifically for the purpose of stimulating and simplifying the set-up and operation of pan-European RIs. The article offers an analysis of ERIC from the perspectives of legal, organisational and science policy studies. The findings demonstrate that enactment of the legal instrument signals the increasing involvement of a supranational body in a traditionally intergovernmental context of science policy. ERIC as a legal framework is characterised by its flexible nature in the sense that members of ERIC enjoy a significant discretion as to, for example, internal structure and financing. The taxonomy of twenty RIs which have to date been set up under ERIC status underlines the all-encompassing nature of the legal tool, which raises a number of further scholarly questions addressed here.

Entrepreneurial orientation, firm strategy and small firm performance

This article explores how individual entrepreneurial orientation dimensions influence the relationship between competitive strategy and firm performance. The findings show the different impacts of individual entrepreneurial orientation dimensions on competitive strategy and the effects of cost leadership and differentiation on performance. Innovativeness is related most highly to differentiation strategy. Risk-taking and competitive aggressiveness are negatively associated with both differentiation and cost leadership strategies. Both differentiation and cost leadership strategies are positively related to performance. This study refines our understanding of the effects of entrepreneurial orientation on small firm performance.

Early Biocompatibility of Brown Macroalgal Scaffolds in a Splinted Full-Thickness Rodent Wound Model : A Pilot Study

Wounds are an increasing clinical and socioeconomic burden motivating the development of sustainable and biocompatible biomaterials for wound healing. Collagen-based extracellular matrix products can improve healing but are limited by cost and ethical or cultural constraints. Cellulose-rich macroalgal matrices offer a potential sustainable alternative. This pilot study evaluated the biocompatibility and wound-healing performance of brown macroalgal scaffolds. Scaffolds derived from Laminaria digitata (LD) and Saccharina latissima (LS) were produced using the visible-light method. Indirect cytotoxicity was assessed in keratinocytes, and in vivo effects were evaluated in a splinted dorsal excisional wound model in Sprague Dawley rats (n = 24), comparing LD, LS, bacterial cellulose (a CACS), and standard of care (SOC). The LD and LS extracts were non-cytotoxic, and no adverse reactions were observed in vivo. Wounds treated with LD, LS, and the SOC showed faster wound closure than the CACS at intermediate timepoints. Inflammation and foreign-body response scores were low and comparable across all groups. The LD showed significantly greater fibroblast infiltration than the CACS at day 7, and at day 14, the LD group exhibited the highest collagen area fraction. These findings indicate that LD and LS scaffolds are non-cytotoxic, are well-tolerated in vivo, and influence wound repair in full-thickness wound models, warranting further study as sustainable biomaterial.
